Terms & Conditions

All bookings accepted by the owner, Mrs Ros Siddons, are subject to these Terms and Conditions, which are deemed to have been accepted in full by the Hirer and all persons in the party. Payment of the deposit also indicates the Hirer’s acceptance of these Terms and Conditions.

Under no circumstances may more than the maximum number of persons, as stated in the details, occupy the accommodation, including sleeping overnight.

The Hirer signing the Booking Form agrees to accept legal responsibility on behalf of members of his, or her, party, and agrees to ensure that they are aware of the Conditions of Hire and that they meet their obligations arising from them in every way. The Hirer accepts legal liability for any acts or defaults of members of his, or her, party as if their acts were his, or her own.

The Hirer failing at any time before, or during, the hire period to meet his, or her, obligations as set out above and elsewhere in this document shall have deemed to have cancelled his, or her, contract with the owner who may seek to repossess the property forthwith.

When a booking is made more than 28 days prior to the arrival date, a deposit of two-thirds of the total hire charge (up to the nearest pound) together with a completed Booking Form, or written confirmation giving the numbers of adults and children, as well as arrival and departure dates, is required to confirm the reservation. Up to that time it is a provisional booking; and provisional bookings are held for a maximum of 7 days. Upon payment of the deposit and subject to the acceptance by the owners of the booking the Hirer becomes liable for the balance of the hire charge for the full period of hire.

It is the terms of the contract that the balance of the hire charge is due for payment 28 days before the Hirer’s arrival. Non-payment of the balance by the due date shall be deemed to be a cancellation and the deposit forfeited. The Hirer may be liable for the total rent and for any other costs required to re-let the accommodation. If successfully re-let credit will be given subject to the re-letting costs and a £100 cancellation fee.

When a booking is made less then 28 days prior to the arrival date the full hire charge is required to confirm the reservation; until payment the booking shall remain provisional.

The Hirer remains liable for the full balance of the hire charge. However every reasonable effort will be made to re-let the accommodation, and if successful a refund will be made accordingly:

a) When notification is more than 28 days prior to arrival, and subject to the accommodation being re-let, the deposit will be refunded less £100 cancellation fee.

b) When notice is within 28 days, the full booking fee is forfeited to the Owner. Any refund is subject to the accommodation being re-let less costs whereof and £100 cancellation charge.

You are requested to arrive no earlier than 3.00 pm. On the morning of departure, please leave by 10.00 am.

The Hirer and members of the party are asked to leave the accommodation clean and tidy. The Owners reserve the right to make a charge for extra cleaning if the accommodation is not left in a satisfactory condition. The Hirer undertakes to report all breakages, or damage as soon as reasonably possible so that it can be replaced, or repaired for the convenience of the Hirer, or subsequent holidaymaker.

The Owner requests that furniture is not moved, or re-arranged so that unnecessary damage does not occur. The Hirer undertakes to keep the property and all the furniture, fittings and effects in, or at, the property in the same state of repair and condition as at the commencement of the hire period, (reasonable wear and tear excepted) and is responsible for the cost of making good any damage which has occurred due to negligence or irresponsible behaviour.

The owners, Mr & Mrs D. Thurlow, shall be under no liability to any person, or member of a holiday booking for any personal injury, loss, theft, or damage to personal effects howsoever arising at the accommodation. Nor can the owners be held responsible for any circumstances beyond their control including, but not limited to, mechanical breakdown, failure of any public service supply, or illness.

No pets are allowed at the property.

Smoking is NOT allowed inside the property.

If for any reason beyond the control of the owners the property is not available on the dates booked (owing to fire damage for example) or the property is unsuitable for letting, the hire charge paid in advance by the
Hirer will be refunded in full but the Hirer will have no further claim against the owners.

The Owner reserves the right to decline accommodation. The Owner has right of access to the property at all reasonable times with or without workmen for the purposes of inspection, or to carry out repair deemed necessary to the property, or equipment.

The Owner gives all information and makes all statements in good faith and checks so far as is reasonable all the information given to applicants. The Owner shall not be liable for any loss or damage resulting from information given, or statements made whether orally, or in writing.

The Hirer agrees that as the property is used for short-term hire as holiday accommodation it is exempt from security of tenure under the Rent Acts.
